Unless otherwise stated, all intellectual property rights in the DigMe platform and its original content are owned by or licensed to DIGME Limited.
This includes, but is not limited to:
These materials are protected by applicable copyright, trade mark and other intellectual property laws.
Nothing in these terms transfers ownership of DigMe's intellectual property to any user, company, site operator or other third party.
Subject to compliance with applicable terms and conditions, DIGME Limited grants authorised users a limited, non-exclusive, non-transferable and revocable right to access and use DigMe for its intended business and operational purposes.
Users must not, without prior written permission:
Nothing in this clause restricts activities that cannot lawfully be restricted under applicable law.
Companies, site operators and other authorised users retain ownership of the intellectual property rights they hold in the information and materials they upload or provide through DigMe.
This may include:
By uploading or providing content to DigMe, the relevant user or organisation grants DIGME Limited a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, transmit and otherwise use that content to the extent reasonably necessary to operate, maintain, support and improve the platform and provide its intended services.
This licence includes making the relevant content available to authorised users and organisations for the purposes for which it was supplied.
The licence continues for as long as reasonably necessary to fulfil those purposes, subject to applicable retention obligations and any agreed arrangements.
The content owner remains responsible for ensuring that it has the necessary rights and permissions to upload and distribute the content.
Users must not upload, publish, distribute or otherwise make available content through DigMe that:
DIGME Limited may restrict access to, remove or disable content where reasonably necessary to address alleged infringement, unlawful activity, platform security or other legitimate operational concerns, subject to applicable law and contractual obligations.
If a person believes that material made available through DigMe infringes their copyright or other intellectual property rights, they may contact DIGME Limited with details of the material and the rights concerned.
We may investigate the complaint and take appropriate action, which may include restricting access to the material or requesting further information from the relevant user or organisation.
Submitting a complaint does not automatically establish that infringement has occurred.
If users provide suggestions, ideas or feedback about DigMe, DIGME Limited may use that feedback to develop, maintain or improve the platform, subject to applicable law and any separate confidentiality or contractual obligations.
This clause does not transfer ownership of intellectual property that belongs to the person providing the feedback.
DigMe may incorporate or link to third-party software, services, content or other materials.
Such materials remain the property of their respective owners and may be subject to separate copyright notices, licences or terms of use.
Nothing in this clause grants users rights to third-party intellectual property beyond those rights expressly provided by the relevant owner or licence.
All rights not expressly granted under these terms are reserved by the relevant intellectual property owner.
Unauthorised use of protected material may result in legal action or other remedies available under applicable law.
This clause is governed by the laws of New Zealand, subject to any applicable mandatory legal requirements.
